STANDARD TERMS AND CONDITIONS OF SALE

1. GENERAL

  1. The client explicitly waives its own standard terms and conditions, even if these were drawn up after these standard terms and conditions of sale. In order to be valid, any derogation must be expressly agreed to in advance in writing.
  2. Thunder & Neon (PVT) LTD undertakes to do its best to supply performant services in due time in accordance with the agreed timeframes. However, none of its obligations can be considered as being an obligation to achieve results. Thunder & Neon (PVT) LTD cannot under any circumstances, be required by the client to appear as a third party in the context of any claim for damages filed against the client by an end consumer.
  3. In order for it to be admissible, Thunder & Neon (PVT) LTD must be notified of any claim by means of a letter sent by recorded delivery to its registered office within 8 days of the delivery of the goods or the provision of the services.
  4. All our contractual relations will be governed exclusively by Sri Lanka law.

2. PRODUCT SPECIFICATIONS

Product details and sizes as per indicated on the Quatation. Illumination related details as highlighted below for each relevant specification,

NEON: Neon sign will be made with weather proof transformers, silicon wire, high tension circuits, U.S.A. made Neon Tubes, glass insulators, glass tube supports with stainless steel base and ceramic collar type electrodes.

LED Module: The sign will be made using highly efficient energy saving SMD 2835 Injection Molded LED Modules which are rated at IP33 (indoor)/ IP65 (Outdoor) options. Constant voltage adoptive technology is built in to the modules and LED’s are guaranteed for 2 years.

LED Strips: The sign will be made using highly efficient energy saving SMD 2835 LED Strips which are rated at IP33 (indoor)/ IP65 (Outdoor) options. Constant voltage adoptive technology is built in to the modules and LED’s are guaranteed for 2 years.

3. INSTALLATION

If a sign is to be installed outstation, an additional charge of 5% of the total cost of the sign will be levied as outstation expenses (if not indicated on the quotation) to meet the additional overhead expenditure incurred by our staff. Transport charges will also be levied at Rs. 150.00 per running km each way (up and down) for lorry and Rs. 220.00 per km for boom truck. 

If it is necessary to hire scaffolding, (inclusive of erecting and removing charges) or a crane to install a sign the customer will have to provide them or the expenses with regard to same will have to be borne by the customer. 

If the sign installation process requires power, its customers responsibility to provide 30A (amps) of power within 10 meters range of sign installation.

4. DELIVERY & COMPLETION

Delivery time will be indicated on the quotation from the date of receipt of the 85% advance payment along with an official purchase order & Design Confirmation.

If the required raw materials are not available at the time of approval or whilst on production, due to restrictions / import restrictions / changes in government policies, the intended / agreed time of delivery of the entire project will be changed.

5. POWER SUPPLY

Power supply up to the location where the sign is to be installed will have to be provided by the client. Once quotation is approved, electrical Diagram will be provided. 

6. WORK INSURANCE

We will provide the work insurance policies related to installation of the signage including erection all risk policy, Goods in Transit & Workman Compensation Policy (WCI) free of charge (FOC) (has limits). If a client requests any insurance policies in addition to the policies offered FOC, additional charges will have to borne by the client. 

7. WARRANTY

Validity: Two (2) years for the Signage, Neon Tubes, LED Modules, LED Strips. Twelve (12) months warranty on LED Tube lights and Acrylic against Manufacturing Defects. Six (06) months warranty on Outdoor Digital Printed work.

Not Covered: We will not be held ourselves responsible for any damage caused by Acts of God, misuse of the product or any operations carried out by a technician other than ourselves.

VOID IF: Our warranty will cover the posts and the structure of the sign boards, provided that maintaining the structure and posts are customers’ responsibility. Regular maintenance is required especially in the coastal areas to prevent corrosion and in the up-country areas to prevent accumulation of moss. It's customers responsibility to provide ample access to the name board to carry out our maintenance works efficiency. The customer is required to pay additional outstation transport charges, should the hire of boom truck or scaffolding become necessary for maintenance, and customer undertakes to pay such charges unless it provided by the customer. On request a quotation will be submitted for maintenance work. 

8. MAINTAINANCE AFTER WARRANTY

At the completion of the warranty period the customer has the option of signing for a maintenance agreement for Neon/ LED Accessories with Thunder & Neon (Pvt) Ltd. As per the said agreement Thunder and Neon (Pvt) Ltd will ensure maximum customer satisfaction from their signage. Repairs will be undertaken as per the agreed conditions. Customer there who will covered by the maintenance agreement will be able to use the name board without any interruption. Percentage of the board cost will be charged annually for the continuation of the maintenance agreement.

9. DESIGN OWNERSHIP

These Estimates & Designs are intellectual property of Thunder & Neon (Pvt.) Ltd. and it is strictly prohibited to alter, copy or to re-produce them to a third party, since the intellectual property rights are received. Also, it is strictly prohibited to provide these designs owned by the Thunder & Neon (Pvt.) Ltd. any third party without the expressed written consent of the Thunder & Neon (Pvt.) Ltd.

Please note that infringement of the rights of Thunder & Neon shall be liable for Civil Action and also to pay damages and losses.

N: B: In the event the quotation is not approved, the cost for the special designing will have to be borne by the customer.

10. TERMS OF PAYMENT 

All the cheques should be drawn in favor of Thunder & Neon (Pvt.) Ltd. The customer should pay 85% advance payment with the order confirmation and balance 15% on completion. Subsequent alterations or changes to the sign after the approval would be charged for accordingly. As this sign is custom made, the advance paid on this order will not be refunded

Our invoices are payable upon invoiced, unless another payment timeframe is indicated on either the invoice or the order. In the event of non-payment by the due date, Thunder & Neon (PVT) LTD reserves the right to request a fixed interest payment amounting to 10% of the sum remaining due. Thunder & Neon (PVT) LTD will be authorized to suspend any provision of services without prior warning in the event of late payment.

If a payment is still outstanding more than sixty (60) days after the due payment date, Thunder & Neon (PVT) LTD reserves the right to call on the services of a debt recovery company. All legal expenses will be payable by the client.

As per the current government regulations customer is liable to pay any sales related taxes (SSCL, VAT etc). However at the time of invoicing of the project, if any government policy changes, the full amount of the said taxes will have to be borne by the customer. 

Customer should bear the additional charge when requesting a Bank Guarantee or a Performance Bond.

VALIDITY

This offer is valid only for 14 days from the date of quotation. We trust the foregoing will meet with your approval and look forward to receiving your valid order.
